SSDU Player Arrested: SDSU football player arrested: Former San Diego State University athlete Araiza was cleared of rape charges.
Matt Araiza, a former player for the Buffalo Bills, and his former teammates on the San Diego State football team will not be prosecuted in connection with an alleged gang rape of a minor that took place at an off-campus party in October 2021, according to an announcement made by county prosecutors in San Diego on Wednesday. Araiza and his former teammates were accused of committing the rape at the party.
Prosecutors issued a statement in which they claimed, “Ultimately, prosecutors determined that the evidence does not support the filing of criminal charges and there is no pathway to a possible criminal conviction,” referring to their conclusion that criminal charges should not be filed. “Prosecutors are only permitted to file charges when they have the ethical conviction that the allegations can be proven beyond a shadow of a doubt.”
When the case was first submitted in early August, the prosecutor’s office said that the San Diego Police Department did not propose filing any charges.

There is now an ongoing civil case.
Araiza was let go by the Bills on August 27, two days after a civil lawsuit was filed alleging that he had off-campus sex with a then 17-year-old high school senior who was underage in California at a party that took place at his apartment in the early morning of October 17, 2021 when he was a member of the SDSU football team. The party took place when Araiza was still a student at San Diego State University. According to the lawsuit, Araiza, who was 21 years old at the time, then took her to the home, where at least three other men, including the two other defendants named in the lawsuit — who were Araiza’s then-Aztec teammates Zavier Leonard and Nowlin Ewaliko — were found, and that she was repeatedly raped for approximately 1.5 hours. During the alleged deed, her nose, navel, and ear piercings were torn out, and she was allegedly bleeding from her vagina. These allegations are made in the complaint.
The youngster contacted the San Diego Police Department the next day to report the rape she had experienced. After waiting another nine months, on August 5, 2022, the San Diego Police Department handed over their investigation to the District Attorney’s Office so that it could be reviewed.
SSDU Player Arrested
Plaintiff attorney Dan Gilleon stated in a statement to ESPN that he is “never surprised” when a prosecutor chooses not to seek charges of sexual assault when the victim was under the influence of alcohol or drugs. It is an extremely uncommon occasion for the criminal justice system to accomplish anything that the victim of a sexual assault would consider to be acceptable.
“The lawsuit that we have filed is not being processed via the criminal justice system…. We want to pursue our case through the civil court system, which is the only venue in which a victim of sexual assault has a chance of receiving justice.
Kerry Armstrong, who represents Araiza in criminal proceedings, has been quoted as saying to ESPN in the past that his client did speak to the girl during the party, but that the rape claims are “just plain wrong.” After it was announced that the claims were being made, Araiza issued a statement in which he claimed, “The facts of the incident are not as presented in the lawsuit or as presented in the press.” I am looking forward to elucidating this matter as soon as possible.
Following the filing of the complaint, Leonard’s name was taken off the SDSU list, and Ewaliko’s absence from the roster meant that he could not participate in training camp.
SDSU football player arrested
According to a statement released by the prosecutor’s office on Wednesday, sexual assault experts analyzed the evidence in the case, which included over 35 recorded witness interviews, the results of a Sexual Assault Response Team (SART) investigation, DNA results, and “forensic evidence from mobile phones and video evidence of the incident itself,” among other pieces of evidence.
Additionally, the prosecutor’s office said that it “met twice with the young woman at the center of this case” and that it “worked with SDPD to conduct further investigations, which led to the questioning of additional witnesses.”
In a statement released on Wednesday, the President of San Diego State University, Adela de la Torre, said that the university’s inquiry into student conduct is still continuing, despite having received clearance from the San Diego police department in July to continue their own probe.
